Orphan Works Legislation Could Affect Your Pictures and Videos

Tuesday April 29, 2008

If you take your own pictures or videos for your blog and upload them to Flickr, YouTube or another photo or video sharing website, then you might want to familiarize yourself with the Orphan Works Legislation that is currently being discussed in Congress.

Beth Peterson, About.com's Guide to Pottery, gave me the heads up on the Orphan Works Legislation, and it's definitely something bloggers should take a look at. You can follow the link to get all the details about Orphan Works Legislation.

In short, the bill would cause your copyrights on your original photos and videos to be forfeited automatically if you post them online unless you first pay a copyright registration company fees to protect your rights to your own work. In other words, the burden of proof that you own your personal photos and videos will rest on your shoulders by first paying the necessary registration fees. Without paying those fees, your photos and videos can be used by anyone, anywhere. If you're against this legislation, you should write to your congressperson to oppose it.
